LEGAL AGREEMENT (Important)

I confirm that:

  • I have read and understood the Terms & Conditions
  • I acknowledge risks associated with moving
  • I accept responsibility for items not packed by Strong Arm Movers
  • I agree to the limitation of liability outlined below
  • I agree this form forms part of the service contract

STRONGER LEGAL CLAUSES (ACL-COMPLIANT)

Here’s the important part — legally safer wording under Australian Consumer Law:

LIMITATION OF LIABILITY (ACL ALIGNED)

Nothing in this agreement excludes, restricts or modifies any rights or remedies the customer may have under the Australian Consumer Law (ACL).

To the extent permitted by law, Strong Arm Movers limits its liability for:

  • Loss or damage arising from:
  • Inadequate or customer-packed items
  • Pre-existing damage
  • Items moved against advice
  • Restricted or unsafe access conditions

Where liability cannot be excluded under the ACL, Strong Arm Movers’ liability is limited to:

  • Re-supply of the services; or
  • Payment of the cost of having the services supplied again

PACKING DISCLAIMER

Strong Arm Movers is not responsible for internal damage to cartons packed by the customer unless external damage is evident and caused directly by our negligence.

PROPERTY DAMAGE CLAUSE

The customer acknowledges that minor damage (including scratches, dents, or marks) may occur due to:

  • Tight or restricted access
  • Heavy or bulky items
  • Property structure limitations

Such minor damage is considered inherent risk of moving and not negligence.

HIGH-RISK ITEMS

Items such as TVs, glass, marble, antiques, and electronics must be:

  • Packed in original packaging or
  • Professionally packed by Strong Arm Movers

Failing this, the items are transported entirely at customer risk.

CUSTOMER ASSISTANCE

Any involvement of the customer or third parties during the move is undertaken at their own risk. Strong Arm Movers is not liable for injury or damage resulting from such involvement.

REFUSAL OF SERVICE

Strong Arm Movers reserves the right to refuse or stop work if:

  • The job is unsafe
  • Required details were not disclosed
  • Access conditions differ significantly from those declared

I agree (i) to the above checklist of risk assessment, I acknowledge that I have read and understood the risk assessment form. In case there are any items that are not packed/not securely packed, items that need to be dismantled and are moved without dismantling with my permission and if items (heavy/awkward) are to be moved from any awkward access. I take full responsibility, in case there if any damage to these items.
